BALANCING INNOVATION AND SECURITY: EVALUATING DATA PROTECTION AND CYBERCRIME FRAMEWORKS IN INDIA AND LIBERIA

Abstract
This study comparatively examines the legal and institutional frameworks governing data protection and cybercrime in India and Liberia. India has recently strengthened its digital governance regime through the enactment of the Digital Personal Data Protection Act, 2023, complementing the Information Technology Act, 2000, while Liberia continues to develop its cybersecurity ecosystem through legislative reforms, electronic transaction laws, and regional commitments under African Union instruments. Through doctrinal legal approach and comparative analysis, this study evaluates whether the legal frameworks of both countries adequately balance technological innovation with cybersecurity and privacy protection. The research further examines international legal instruments including the Budapest Convention on Cybercrime, the African Union Malabo Convention, OECD Privacy Guidelines, and relevant United Nations initiatives. It concludes that while India possesses a comparatively mature digital legal framework, both jurisdictions continue to confront significant challenges in institutional capacity, cross-border cooperation, enforcement mechanisms, and public awareness. The study recommends harmonization with international standards, stronger institutional oversight, enhanced judicial capacity, and increased international collaboration to create resilient cyber governance systems.
