Abstract

Circumstantial evidence occupies a vital position in criminal jurisprudence, particularly in cases where direct evidences are unavailable or unreliable. Indian courts have consistently recognised that a conviction maybe sustained solely on circumstantial evidence, provided that the chain of circumstances is complete and excludes every reasonable hypothesis other than the guilt of the accused. This paper examines the concept and evidentiary value of circumstantial evidence, its significance in criminal trial, and the judicial principles governing its application under the Bhartiya Sakshya Adhiniyam, 2023.
